Probate Administration: When minimal assets are involved...

In certain cases, the family may not need to proceed through the full probate process. In cases involving little assets or land, simpler alternatives may be available:

  • Muniment of title: If your loved one's estate is small, you may petition to the court for probate muniment of title only. If the court approves the petition, essentially bills are paid and assets are distributed to heirs according to the will.
  • Affidavit of heirship: If your loved one died without a will in place and had minimal assets, there still may be an alternative to full estate administration. You can file an affidavit of heirship with the probate court indicating the proper heirs according to Texas probate laws and the amount of assets in the estate. If approved, assets are distributed according to the affidavit.

However, if your loved one had significant amounts of assets in stocks, bonds, trusts, real estate and financial accounts, the full probate process may be necessary.
